Renting in Saigon: what is normal

These are common market practices, not laws. Always read your own contract.

• Lease length: 12 months is standard. Some landlords accept 6 months; 2-year leases can get lower rent. For stays under 6 months, serviced apartments are easier.

• Deposit: usually 2 months' rent, paid with the first month when you sign. A holding deposit before signing is often 1 month or 10–20 million VND.

• What's included: condo rent usually includes the building management fee (ask to be sure). Electricity, water, internet and parking are usually extra. Most condos come furnished. Serviced apartments include Wi-Fi and cleaning but cost about 20–30% more.

• Agent fee: in HCMC the landlord usually pays the agent, but some agents charge tenants. Ask before you start.

• Avoid problems: see the original pink book (sổ hồng) and check that the owner's ID matches before paying any deposit; get a written bilingual contract; write the electricity price into the contract; if your company needs a red invoice (hóa đơn đỏ), agree on it before signing; take dated photos of everything on move-in day.

Lease contract and residence declaration

• A housing lease must be in writing (Housing Law 2023, Article 163). It should name both parties, describe the home, and state the price, payment, term, rights and duties.

• A lease does not need a notary (Article 164 lists notarization only for sales, gifts, exchanges, capital contributions and mortgages). You may still notarize it if you both want.

• Residence declaration: your landlord must declare you to the ward police within 12 hours of moving in, online or with form NA17. Give your passport and visa or residence card so they can do it.

• Landlord's tax: the owner pays the tax on rental income. From July 2026, rent up to 500 million VND a year has no VAT or income tax but must still be declared.

Electricity and water bills

Electricity (home tariff, VND per kWh before VAT, Decision 1279/QĐ-BCT from 10 May 2025; no newer price decision found as of Oct 2026):

• 0–50 kWh: 1,984 · 51–100: 2,050 · 101–200: 2,380 · 201–300: 2,998 · 301–400: 3,350 · over 400: 3,460

• Landlords may not charge you more than the power company's bill (Circular 60/2025/TT-BCT). Tenants with a lease of 12 months or more and a residence declaration get the home tiers. Overcharging can be fined 20–30 million VND, and the landlord must refund you (Decree 133/2026/NĐ-CP, from 25 May 2026).

Water (HCMC, VND per m³ before VAT and fees):

• First 4 m³ per person per month: 6,700 · next 2 m³: 12,900 · above 6 m³: 14,400

• Plus 5% VAT and a wastewater fee of 30% of the water charge. The cheap amount is tied to each registered resident, so ask your landlord to register you.

Can foreigners buy an apartment?

Yes, under the Housing Law 2023 (in force since 1 Aug 2024) and Decree 95/2024/NĐ-CP:

• Who: foreigners allowed to enter Vietnam, with a valid passport with an entry stamp. Foreigners married to Vietnamese citizens and living in Vietnam have the same housing rights as Vietnamese citizens.

• What: apartments and houses in commercial housing projects that are open to foreign buyers (not in defence or security areas). HCMC publishes lists of projects open to foreigners; check the list before paying.

• Limits: foreigners may own at most 30% of the units in one apartment building, and at most 250 houses in an area the size of a ward.

• How long: up to 50 years from the date on the pink book, extendable once for up to 50 more years.

• From whom: from the developer, or from another foreign owner. Buying a resale unit from a Vietnamese owner is not clearly settled; ask a lawyer first.

• A purchase that breaks these rules is invalid and no pink book is issued.
